WARNING: Under Indiana law, there is no liability for an injury or death of a participant in an agritourism activity if it results from the inherent risks of the activity. Inherent risks include risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agritourism activity. (IC 34-31-9-3)
Acknowledgement of Risks: I understand that my participation (and that of any minors in my care) may involve, among others: walking on uneven ground, mud, gravel, or straw; riding on wagons, barrel trains, or slides; participating in games and physical activities; interaction with farm animals which may bite, nibble, kick, or knock down participants; exposure to bacteria or allergens; weather-related conditions including heat, rain, or wind; and the presence of inflatables, corn pits (choking hazards), and other farm equipment. I acknowledge these risks and agree that participation is voluntary.
Release of Liability & Indemnification: In consideration of entry onto the property: I release and hold harmless Trowbridge Farms, LLC, its owners, employees, and volunteers from any and all liability for injury, loss, or damage, except in cases of gross negligence or willful misconduct. I further agree to indemnify and defend Trowbridge Farms against any claims, costs, or expenses (including attorney’s fees) arising from my participation or the participation of minors under my supervision. I understand and accept that I am responsible for supervising any minors in my care at all times while on the property.
Medical Authorization: In the event of an injury, I authorize The Amazing Maze staff to obtain medical treatment deemed necessary and agree to be financially responsible for such treatment.
Agreement: I have read and understood this waiver. By signing below, I acknowledge the inherent risks of participating in agritourism activities and voluntarily assume them. This agreement shall be governed by the laws of Indiana, and any dispute shall be resolved in Noble County, Indiana.
